The Moscow City Court dismissed an appeal against the sentence of oppositionist Alexei Navalny on charges of fraud in collecting donations and contempt of court when considering another criminal case, on slandering veteran Ignat Artemenko. Consideration of the criminal case on the merits ended with the fact that he was appointed 9years in a strict regime colony.
Consideration of the complaint against the sentence against Alexei Navalny began with the fact that the oppositionist, speaking via video link, asked to postpone the process.
The politician gave two arguments: firstly, he needed to compare the text copy of the verdict with the audio recording of what was read out at the meeting. Secondly, Navalny asked to be given the opportunity to have a proper meeting.
— On [May] 24, you would have condemned me very nicely and I would have gone to a strict regime, — he argued.
The panel of judges agreed with his arguments, and today the appeal against the verdict in the case, in which there are two episodes, will be considered. According to the investigation, in 2017 Navalny raised money for his presidential campaign, although his nomination was impossible - he had a criminal record. The politician himself insisted that this was an incorrect interpretation of the laws.
The second episode concerns a criminal case of libel against a veteran of the Great Patriotic War, Ignat Artemenko, who participated in a video in support of amendments to the Constitution. During the consideration of this case, according to investigators, Navalny showed contempt of court, in particular, he called Judge Vera Akimova Obersturmbannführer.
This time the journalists were allowed to start the meeting - the last time it started without them, and the judges had to announce a break so that the correspondents were allowed into the hall. After ten minutes of technical checks, a trio of judges entered the hall and presiding judge Maria Dovzhenko opened the meeting.
Lawyers Vadim Kobzev and Olga Mikhailova confirm that, as requested at the last meeting, they got acquainted with the record of the verdict of the first instance. This is where the judicial investigation ends immediately, since the examination of evidence is not required. Debates begin.
Mikhailov's lawyer believes that the verdict of the Lefortovo Court is subject to unconditional cancellation, as it is unfair and issued with procedural violations. She dwells separately on the fact that, by its decision, the court canceled the suspended sentence from the verdict in the Kirovles case and changed the verdict in the Yves-Rocher case. At the same time, in both past cases, decisions of the ECHR were issued, which indicate violations for which Russia has already paid compensation.
Based on the totality of previous sentences, Mikhailov calls the new punishment of the Lefortovo Court "a flagrant violation of international obligations. "
She again points to procedural violations: the territorial lack of jurisdiction of the Lefortovo court and the consideration of the case in fact in a correctional colony, where the defense was deprived of all technical means.
The next defense argument: violation of the secrecy of the meeting room. Lawyers do not understand where the deliberation room was actually located - in the colony in Pokrov or in Moscow. Therefore, if the judge traveled from the Vladimir region to the capital, but continued to work "in the deliberation room", then this, according to Mikhailova, is also a violation.
Finally, Mikhailova dismisses the accusation of fraud and embezzlement of donations. She returns to the defense position that Navalny did not lose the right to participate in the presidential elections after the verdict in the Kirovles case.
The prosecution, according to the lawyer, did not prove that Navalny used any donations for personal needs. Therefore, both the event and the corpus delicti are absent in the case.
Mikhailov's lawyer moves on to the second count, which concerns disrespect for the participants in the trial in the case of defamation of the veteran.
She notes that none of the victims ever appeared in court. “Whether they consider themselves truly offended is not known,” she sums up.
Navalny did not use profanity, and the examination of the defense did not confirm that his phrases could be considered offensive in the context of the veteran's defamation trial.
“We believe that the verdict of the Lefortovo court has no right to life, it should be canceled,” Mikhailov's lawyer ends his speech. Mikhailova's colleague Vadim Kobzev supports her arguments. He reminds that if Navalny enters into force after today's decision, Navalny will go to a strict regime colony. This became possible because the Lefortovo court considered Navalny a recidivist - one of the episodes of fraud.
Kobzev considers this decision illegal. He recalls: Navalny was accused of "starting" fraud even before the probation in the Yves-Rocher case was replaced with a real one in January 2021. But the victim Alexander Karnyukhin made three more donations after the arrest of the oppositionist. Since Navalny was already in custody, he could not use these funds in any way.
In extreme cases, according to Kobzev, this could be considered an attempted crime, and not a relapse. This means that “there can be no talk of a strict regime colony,” Kobzev finishes. 9Judge Dovzhenko gives the floor to Navalny, but his speech is constantly cut off. There were problems with the broadcast from the colony even before the meeting, when the connection was just being checked.
Kobzev advises Navalny to pause between several words. Mikhailova suggests moving away from the microphone. Nothing helps.
Mikhailova asks for a break to fix problems. A break is not announced, the court employees are trying to establish contact on the go, and nothing happens. Still, a 10-minute break is announced.
During a break, Navalny suddenly turns on via video link: “Hello. I'm not a great specialist, but it seems to me that you have a microphone somewhere next to the speaker.
All of a sudden, everything is getting better, Navalny is asked to count from 1 to 15. “Now the judge will say: “15 years! I chose it myself,” Navalny jokes at the end.
Judge Larkin makes sure that Navalny is well heard. Now it turns out that he does not hear the courtroom well, but Navalny is fine with that. He asks the judge to read the decision louder afterwards.
Navalny begins his speech in the debate. He says that by law he must at this moment try to convince the court with facts. “What can I say to you such an additional thing against the background of what is not completely obvious to you. I was tried here—in prison!” he exclaims.
The oppositionist complains that even under the conditions of coronavirus quarantine, Moscow courts acted according to the rules, but not in the Navalny case. The politician recalls the publication of the FBK, which stated that Judge Kotova called up an employee of the Presidential Administration during the process.
At the end of his speech, Navalny says that Judge Natalya Repnikova, who replaced his suspended sentence with a real one, “told through lawyers she knew” that she regrets her decision. “And after a while, Natalya Repnikova died,” says Navalny, noting that “formally” it happened from the coronavirus.
Therefore, Navalny now recommends that the judges tell him that they are sorry, but "do it carefully."
Prosecutor Nadezhda Tikhonova supports her accusation in the debate and calls the verdict fair. She calls the position of the defense an “assessment”, which does not coincide with the court's decision, but does not indicate its illegality. Regarding the consideration of the case in the colony, Tikhonova recalls that "holding offsite hearings is not prohibited by law. " She believes that nothing prevented the defense from fully participating in the process. “The convict himself never said this,” says Tikhonova. Navalny's sound is turned off, but it is clear that at this moment he begins to laugh.
The prosecutor once again lists the plot of the accusations against Navalny, which were considered in the first instance. “Well, he could not participate in this [presidential] campaign. We had to wait until the conviction was extinguished. It is necessary to comply with the law, ”Tikhonova comments on the accusation of fraudulent fundraising. She also repeats the arguments about the fairness of the accusation of insulting the judge and participants in the trial of defamation of a veteran.
Tikhonova notes that the defense has no evidence that the secrecy of the judge's deliberation room was violated. She also does not believe that the decree of President Vladimir Putin, who promoted her, could have influenced the judge's decision.
The prosecutor requests that the sentence be left unchanged.
Navalny speaks with the last word.

Navalny recalls that this is his sixth or seventh last word in a year and a half. But during his “last last word” in the assembly hall “in my prison”, the technical specialist was absent: “But our major, who deals with all sorts of technical garbage, he was dressed in civilian clothes and put in the place of a technical specialist of the court.”
According to Navalny, this major turned off the microphone every time the oppositionist spoke about the war.
Navalny says that all these tricks, on the contrary, inspired him: “You are afraid that some prisoner will say something, you are so afraid that they put in a special officer dressed as a civilian for him to press a button.
He says that he personally has nothing against the current judges: "When I say 'you', I mean all your power."
The verdict of the Lefortovo court, continues Navalny, speaks of insulting the judge. “No one respects the Russian court,” the oppositionist notes. According to Navalny, an article about contempt for the court would be more suitable for him: “I despise your court, I despise your system and despise your power.” He says that he is not afraid of this system.
Navalny then calls the Putin-led system enemies, traitors and murderers of the Russian people. At this point, Judge Dovzhenko urges him to return to the issue at hand. Navalny argues that the Code of Criminal Procedure allows him to say whatever he likes in the last word.
“You don't like it when I talk about the war? Then I will use this war as a metaphor for your ships. This war, like your courts, is built entirely on lies. Not one word of truth!
Judge Dovzhenko again interrupts Navalny as he recalls how no one believed US intelligence reports about Russia's impending attack on Ukraine. Navalny, in response, asks the judge to pay attention to the walls of the hall, where there are portraits of lawyers who also made various speeches in court.
“You can just stop me and turn me off, but I'll say whatever I'm going to say,” Navalny says and continues.
Navalny says that “the same rubbish” that is used on TV during the war was used in the sentences against him. Separately, he dwells on the thesis about the confrontation with NATO. Navalny recalls how the Russian authorities opened the NATO base in Ulyanovsk. “Bold lies in every word, ignoring what was said yesterday. You all change shoes in the air, not just often, but constantly.
Judge Dovzhenko again reminds that he wants to hear Navalny's objections to the verdict of the Lefortovo court. In response, the oppositionist says that there are pluses in the work of a judge: salary, apartment, immunity. But there are downsides: "You'll have to listen to me. "
“You will all suffer a historic defeat,” Navalny continues about the war and wonders why Russia is waging it at all. “What should they [Ukrainians] do to get left behind?” - he asks a question and cites as an example a conditional judge from Kharkov, on whom shells suddenly begin to fall.

“Since 2015, we have been shown the Armata tank, but in the war, for some reason, T-72 tanks,” says Navalny, referring to corruption in the army and comparing it with the accusation of fraud in the current case.
“I do my best. I have a little left,” he answers the judge’s next objections and again talks about the “bloodbath” that the Russian leadership arranged in Ukraine: “If I can convince at least someone, I will say it.”
Navalny says that instead of judges he sees only “in the name of the Russian Federation”, and therefore wants to tell them: “How nice it would be without you!”. “Everyone needs to leave everyone alone: so that we get off this Ukraine, so that you, judges, get off ordinary citizens,” he continues.
“Your time will not always be there and your time will pass. And when you all burn in hell, your grandfathers will throw firewood, who did not want you to start new wars in the 21st century. That's all I wanted to say".
The decision will be announced at 12:00.

The Cassation Court upheld the 9-year sentence for opposition politician Alexei Navalny, who is now in prison, as legal.
According to RIA Novosti , the court rejected the cassation appeal of Navalny's lawyers against his sentence in the case of fraud and contempt of court.
Now Navalny is in colony of strict regime No. 6 in the Vladimir region. Previously, he was placed in a penal colony after the conditional term was replaced with a real one in the case of " Yves Rocher ". Navalny is also a suspect in a new case: he is charged with running the Anti-Corruption Foundation (FBK *), which has been recognized in Russia as an extremist organization.
According to the new criminal case, the oppositionist may face up to 15 years. The investigation believes that the organization of Alexei Navalny** in the spring of this year called on supporters to go to unsanctioned rallies against the military special operation. He is convinced that such restrictions violate his right to defense.
“The colony, with its strange methods, is trying not only to intimidate, but to physically restrict my political expression. And by restricting it, they took away from me all the ability to defend myself. They completely nullified the ability of Kobzev, Mikhailova and other lawyers to work, ”Navalny said.
Navalny also appealed against the actions of the representatives of the colony in violating the right to defense in court.
