The lawyer obtained an acquittal for the defendant who confessed

The lawyer of the acquitted Alexei Afanasiev noted that the argumentation of the defense was built solely on the facts established by the evidence: every detail that did not fit into the essence of the charge or contradicted it was demonstrated to the jury to the utmost concretized. nine0003

On June 5, the Turochaksky District Court of the Republic of Altai delivered a verdict of not guilty on the basis of the jury's verdict of not guilty against Anatoly Osokin, who was accused of killing a colleague under Part 1 of Art. 105 of the Criminal Code (documents are available from "AG").

Confession

According to the protocol of confession, Anatoly Osokin worked in shifts with R. at a gas filling station. On March 25, 2020, he arrived at the gas station, where he argued with R. about the theft of gas and went home - colleagues suspected Osokin of draining the gas. nine0003

Having drunk, in the period from 00 to 02 hours on March 26, Anatoly Osokin, together with a friend P., returned to the gas station. He took a metal bar from the car and went to R. The girl went with him. R. let them into the camera room, after which a verbal skirmish and scuffle arose between the men, during which Osokin hit his opponent with a rod and continued to beat him until he stopped moving.

Frightened, Anatoly Osokin decided to stage a robbery. To do this, he took money from the cash register, brought gas cylinders into the room, opened them and lit the burner. Osokin, according to the protocol of surrender, decided that there would be an explosion, and therefore no traces of the crime would be found. He locked the door and wiped R.'s blood, which remained on his hand, on the snow. The man took with him a rod and money, which he then threw into the river. nine0003

After that, Anatoly Osokin came home and began to drink wine. Toward morning, he went to B.'s friend with a request to take him to a neighboring town. On the way, the police called him and informed him about the incident at the gas station, after which Anatoly Osokin immediately came to the police. There, he turned himself in and was interrogated with the participation of a defense lawyer, as well as checking his testimony at the crime scene using video recording. The man was then taken into custody.

After that, Aleksey Afanasiev, a lawyer of the Regional AK “NO Altai Territory Bar Association”, entered the case as a defender by agreement, however, in essence, Osokin was no longer interrogated, since the investigators refused the corresponding petition.

Witness statements

The indictment was drawn up on February 24, 2021. According to the document (available to AG), P. did not indicate in her testimony that she was with the accused at the gas station. At the same time, she noted that until about 0000 hours on March 25, 2020, Anatoly Osokin drank with her and Z. Then the couple took Osokin home. According to the girl, he was in a great mood and intended to go to bed, because in the morning he had to work. nine0003

Witnesses S., N. and P. told how on March 26, 2020 they drove up to refuel: the operator did not come out to the company, so the men went to him themselves. S. and N. heard R. snoring and then saw smoke. They noticed that the door to the control room was not closed, and the lock was damaged. S. and N. went into the room and saw R., as well as a pool of blood three meters long. R. tried to move his hand. He did not give first aid, so the witnesses simply blocked the gas cylinders, opened the door and waited for the arrival of the ambulance, police and firefighters. nine0003

Consideration of the case in court

Aleksey Afanasiev told AG that the position of the prosecution was based solely on the confession of the defendant, set out in the protocols of surrender, interrogations as a suspect and the accused, verification of testimony on the spot using video recording. “For the rest, the public prosecutor relied on judgments of a presumptive nature. Moreover, he tried in every possible way to psychologically influence the jury by showing photographs of the corpse and the victim’s bloodied clothes, which, in fact, had no evidentiary value, ”said the defender. nine0003

In the debate, Aleksey Afanasiev referred to the testimony of prosecution witnesses S., N. and P. that R. was wheezing, that the lock had been damaged, as well as to the testimony of Z. and P. In court, Osokin’s friend B. testified that the defendant had the meeting did not look restless. The defense lawyer emphasized that Anatoly Osokin had no motive for committing the murder, there were no serious conflicts between his colleagues, and the testimonies of witnesses do not exclude the commission of a crime by other persons.

The lawyer drew attention to the fact that footprints and fingerprints belonging to unknown persons were found at the crime scene. In addition, a gas burner was seized, which was not previously in the gas filling station, its belonging was not established. nine0003

He noted that during the preliminary investigation, Anatoly Osokin's clothes, cuts of nail plates, shoes, and a car were confiscated. The evidence was examined by the investigator, after which he was sent for biological examination. There were no traces of blood found on any of the presented items, except for the T-shirt.
