What is a break for feeding a child, to whom and how is it provided?

In accordance with Part 1 of Art. 258 of the Labor Code of the Russian Federation for working women with children under the age of one and a half years, , in addition to a break for rest and food, additional breaks for feeding the child (children) are provided at least every three hours of continuous work lasting at least 30 minutes each.
If a working woman has two or more children under the age of one and a half years, the duration of the break for feeding is set at least one hour.
Nursing breaks are available only to working women. And since this article directly indicates the age of the child, each woman will choose what is more profitable and convenient for her: either take leave to care for the child until he reaches the age of one and a half years, or go to work and receive breaks to feed the child.
How can I take advantage of a break to feed my baby?
The very procedure for granting these breaks is simple.
Part 1 of Art. 258 of the Labor Code of the Russian Federation establishes the direct obligation of the employer to provide such a break to a woman who has a child under the age of one and a half years. At the same time, the law does not say “at the request of a woman”, i.e. the employer must be aware of this obligation and fulfill it. However, in order to implement Art. 258 of the Labor Code of the Russian Federation, one way or another, an order will be required. On the basis of this order, the accounting department will keep the average earnings, the timekeepers will put the appropriate marks and not mark absenteeism. In addition, at the time a woman applies for a break, the organization may not have a local regulation on providing breaks for feeding a child. For this reason or for other reasons, the employer may not actually grant a break. Therefore, a written request for breaks must be submitted.
In addition, in accordance with Part 3 of Art. 258 of the Labor Code of the Russian Federation, at the request of a woman, breaks for feeding a child (children) are added to a break for rest and food, or in a summarized form are transferred both to the beginning and to the end of the working day (work shift) with a corresponding reduction.
IMPORTANT! In the application for granting breaks for feeding, you must indicate how you wish to use the right to breaks:
- or at least every three hours for at least 30 minutes each;
- either add the feeding breaks to the rest and meal breaks, i.e. to the "lunch" break;
- or transfer them in a summarized form to the beginning or end of the working day (work shift) with a corresponding reduction.
Thus, by law, a woman is entitled to at least two breaks if she works eight hours a day.

How the rights of working parents are protected in Russia
Transfer to another job
Women with children under the age of one and a half years, in case of impossibility to perform the previous job, are transferred upon their application to another job. At the same time, wages must not be lower than the average earnings for the previous job until the child reaches one and a half years.
Additional breaks
Few people know that the legislation provides for so-called feeding breaks. Working women with children under one and a half years of age, in addition to the lunch break, are provided with additional breaks at least every three hours and at least 30 minutes each. And if there are two or more such children in the family, then this break cannot be less than an hour. Upon request, they can be added to the lunch break or summarized and transferred to the beginning or end of the working day.
Also, these breaks are included in working hours and are subject to payment.
Business trips and overtime work
A mother with a child under three years old can be sent on a business trip or involved in overtime work, work at night, on holidays or weekends only with her written consent and if this is not prohibited by a medical certificate. She has the right to refuse.
Mothers or fathers raising children under the age of five without a spouse have the same right; workers with disabled children; workers caring for sick family members in accordance with a medical report.
Guarantees upon dismissal
It is not allowed to terminate the employment contract at the initiative of the employer:
- with a woman who has a child under the age of three;
- with a single mother with a child under 14 or a disabled child under 18;
- employees who are raising a child under 14 or a disabled child under 18 without a mother;
- with a parent who is the sole breadwinner of a disabled child under the age of 18;
- with the sole breadwinner of a child under the age of three in a family raising three or more young children, if the other parent does not work.
Exception - liquidation of the organization or gross violation of labor duties.
In case of downsizing
In case of reduction in the number or staff of the organization's employees, with equal labor productivity and qualifications, preference in remaining at work is given to employees with a family and children, if there are two or more dependents.
